This Privacy Policy (hereinafter, the “Policy”) is intended to regulate the acts of processing of personal data made by MIGUELEZ, S.L., (hereinafter, “Miguélez”), with registered office at Avda., Párroco Pablo Díez, 157, 24010, León, and NIF (Tax Identification Number) number: B24002404 of the applicants (hereinafter, “Users”) when completing any electronic form available on its website.

1. IDENTITY AND CONTACT INFORMATION OF THE RESPONSIBLE


In accordance with article 13 of Regulation (EU) 2016/179, General Data Protection Regulation (hereinafter “GDPR”), Miguélez informs you that the personal data provided through the electronic forms available on your platform will be incorporated into an activities record for treatment. The Person in Charge of the treatment of personal data, and the owner of the activities record for treatment is Miguélez.

2. PURPOSES AND LEGAL BASIS OF THE TREATMENT

The personal data collected through the forms will be processed by Miguélez for the following purposes:

(i) To be able to manage your request for information or, where appropriate, budget: Miguélez will process the data you enter in the forms to be able to manage your information request or, when appropriate, your budget request, in a more personalized way according to your needs. The basis of legitimacy that allows Miguélez to carry out a licit treatment of your data is the consent you provide when submitting the request, in accordance with article 6.1.a GDPR. We inform you that you may revoke the consent for this purpose at any time, without causing any detrimental effect on the service provided.

(ii) For the submission of commercial communications by any means of communication in accordance with the provisions of article 21 LSSI (Law of Information Society Services and Electronic Commerce). The basis of legitimization that allows Miguélez to carry out a licit treatment of your data is your consent, in accordance with article 6.1.a GDPR. We inform you that you may revoke the consent for this purpose at any time, without causing any detrimental effect on the service provided.

(iii) To manage the payment method on the Website, in case the online purchase option is enabled: Miguélez will process the personal data that you enter in the platform in order to make the purchase of the products in you are interested. The basis of legitimacy that allows Miguélez to carry out a licit treatment of your data is the contractual relationship that binds the User to the entity, which means that the payment process is necessary for the execution of the contract in accordance with article 6.1.b GDPR.

(iv) To manage any claim or withdrawal request: Miguélez will process the personal data that you enter in the platform to address any claim that may be related to the service provided by Miguélez or any request for withdrawal. The basis of legitimacy that allows Miguélez to carry out a licit treatment of your data is the contractual relationship that links the User with the entity, which means that the management of the claims or withdrawals is necessary to end the contractual relationship, in accordance with article 6.1.b GDPR.

The personal data collected through the forms are pertinent, adequate and not excessive according to the purposes for which they are obtained.

Said personal data will be kept until it fulfills the purpose that motivated its reception. Once the indicated period ends, we inform you that Miguélez will keep your data duly blocked for the sole purpose of attending to the responsibilities of any situation that may arise. Your personal data will be deleted when they prescribe such responsibilities.

3. SECURITY MEASURES

Miguélez will treat your personal data in an absolutely confidential way. Likewise, it has implemented adequate technical and organizational measures to guarantee the security of its personal data and to prevent its destruction, loss, illegal access or unlawful alteration. When determining these measures, criteria such as the scope, context, and purposes of the treatment have been taken into account; the state of the art and the existing risks.

4. RECIPIENTS OF THE PERSONAL DATA

Your personal data will not be transferred to other people or companies to be used for their own purposes. However, some entities subcontracted by Miguélez could access your personal data and information in order to collaborate with Miguélez in the management of the personal data.

In particular, the data will be communicated to other companies of the Miguélez business group only in the case that you are interested in contacting or contracting with said companies. Some of the Miguélez group companies are established outside the European Union, so if you need to be contacted by any of them, data will be transferred to these companies located in the following countries:

  • Miguélez Panamá, S.R.L. entity belonging to the Miguélez group located in the Republic of Panama (Parque Industrial Milla 8 Galera 2, Vía Transístmica, Las Cumbres, 0838-01436).
  • Miguélez Chile, entity belonging to the Miguélez group located in the Republic of Chile (Avda. El Retiro, Parque de los Maitenes 1260, Enea-Pudahuel, Santiago).
  • Miguélez Andina, S.R.L. entity belonging to the Miguélez group located in the Republic of Peru (Avda. Eucaliptos s/n, Parcela nº 6, Sub Lote B-2, Lote nº 1).
  • Miguélez USA Corporation, entity belonging to the Miguélez group located in the United States (9990 N.W. 14th Street, Suites 101 & 102, Doral, Florida, 33172).
  • Miguélez Dominicana, S.R.L., entity belonging to the Miguélez group located in the Dominican Republic (C/Julio Ortega Frier, No. 13 - Zona Universitaria, Santo Domingo, Distrito Nacional).
Likewise, we inform you that Miguélez will adopt the necessary measures in terms of data protection to guarantee an adequate level of security in case your data is transferred to third countries which the European Commission identifies as lacking an adequate legal framework for data protection.

5. RIGHTS

You can exercise the rights indicated below before Miguélez. To do this, you must simply send a letter, accompanied by a copy of your ID or equivalent document, to the email address privacidad@miguelez.com. If your request does not meet the necessary requirements, Miguélez may require its correction. If you consider that your request has not been dealt with correctly, you can file a claim with the Spanish Data Protection Agency. The rights you have in terms of data protection are the following:

6. COMMUNICATION OF ILLICIT AND INAPPROPRIATE ACTIVITIES

In the event that the User, or any other Internet user, is aware that the Linked Sites refer to pages whose contents or services are illegal, harmful, degrading, violent or contrary to morality, they may contact Miguélez indicating the following points:

  • Information about the communicator: name, address, telephone number and email address
  • Description of the facts that reveal the illicit or inadequate nature of the Linked Site
  • In the case of violation of rights, such as intellectual or industrial property, the personal data of the owner of the infringed right, when he or she is a person other than the communicator. Also, the title that proves the legitimacy of the ownership of the rights must be provided, as well as, when appropriate, the Certificate of Representation in order to act on behalf of the owner when he or she is a person other than the communicator
  • Express statement that the information contained in the claim is accurate.
The reception by Miguélez of the communication provided in this clause will not imply, according to the provisions of the LSSI, the effective knowledge of the activities and/or contents indicated by the communicator.
